Yes.  It can lead to a birth defect, or other such, as well as most drugas are illegal...  Also, mothers using drugs during pregnancy are more likely to blame themselves for their babies problem, and while it is, they would probably be depressed for a while.

I agree, though I have never really considered this before, it makes sense.   I believe abortion is wrong beacuse I believe a person is human and therefore has rights at the moment of conseption, so it would only make sense that a person who is damging them and getting them addicted to drugs should be punished accordingly.  But that also brings up the question of little stuff like, should they pig out all night on junk food while they're pregnat?  well its not good for the baby, but I dont think we have the right to go and tell people what they can or cant eat while their pregnat, or feed their kids after birth. So, it makes sense that they shouldnt be allowed to do that to a kid, but I dont see enforcing that law very easy...if only people could just love kids enough for this not to be an issue ...

It should be lot harder to have a baby.  What do you guys think about parental liscensing?  It would certainly help curb this problem, but some would see it as an invasion of rights.

I think I would see it as in invasion of rights, I mean, I probably dont really understand it that well, but what if some girl just made a mistake and got pregnat? she has to give him/her away or kill him/her or something?

Well the point of something like that would not be focused on punishment, more on prevention.  I'd say you could see stuff like this coming in some parents, but still, I think it is better the ways it is.

I think mothers should be punished for using drugs while pregnant.  My reasoning, well, I am a crack baby (and God knows what else my mom did)!!!
I was born three months early, was in de-tox for 6 months, and now I have bad joints and fragile bones.  I dislocate at least one joint in my body every month almost, I can't even count how many broken bones I've had, and when I had my baby, even though I'd never used, it must have still been in my system because she was in de-tox for 3 weeks!!  

So, YES, I think mothers should be punished immensly for drug use while pregnant!!!

a baby born into the world deformed because of a women who uses drugs, smokes, or drinks is the one who has to suffer all their life. I think that the woman should be punished by jail time.

[color=fuchsia]i think children who are drug abused while in their mothers womb should be crimminally prosecuted.  Using drugs while pregnant can harm and kill the baby and also the mother, doing drugs can cause teh baby to have HIV/AIDS, PREMATURITY, LOW BIRTH WEIGHT, INFECTIONS, SMALL HEAD SIZE, SUDDEN INFANT DEATH.  These are just some of the many things that can harm the baby, and there are a lot more for the mother, also.

I believe the pregnant women shouldn't be punished, they should be given help.  They should be placed in a treatment center.  All jail time will do is cause stress for the mother and therefore harm the baby even MORE.  Throwing a woman who needs help more than anything behind bars will not help the baby or mother at all.  Addiction is a disease.  There is a reason the mother keeps using.  She can't stop because she is mentally and sometimes physically addicted.  If you havent experienced addiction yourself, either directly or indirectly, you wouldnt fully understand.  People are not themselves when they are on drugs, therefore do things that they wouldn't DREAM of doing sober, like using while pregnant.
And to Squirt1983----
I know directly from experience that there is no withdrawl from crack.  I never used it myself but it is proven that although you feel like crap because you are craving the drug, there NO pyhsical addiction to crack what so ever.  Now if it was coke then there would be withdrawl. But definitely NOT crack.  Check it out if you like.   And concerning your baby, there is no way that anything passed on to you from your mother would still be in your system years later or you would have never made it out of that hospital as an infant.  Your health problems could have affected your baby but definitely not causing it to withdrawl.  If your baby actually went through an actual detox after it was born it was because you probably used.

Find all the crack whores and the babies they have had and try to punish them, it is not going to happen. I think that you should be less worried about what you want to do to them to make them relies it was wrong and just try to help. If you are so concerned you will sit here and type about it them get your butt out there and help someone. I had 3 best friends who were cocaine addicts and each one of them had babies. Is it right, no but they are learning there lesson now getting up at 5 am to breast feed (sober might I add). One of them might be a stripper at night and a student in college by day but she is making money and making sure that her child is getting what she needs. These girls made mistakes but then again who are we to judge when we should be educating. I just think that if all you people have the time to type these, then make some time to help someone else make a good coice, or make themselves a fight.Thanks

Everyone has made  very good points in what they had to say. There is no true answer other than that until pregnant women make the choice to respect themselves and their children the abuse will continue. I say just put it in Gods hands and what will be will be.

In gods hands??? Let's not bring god into this, that's a different topic!  
It's far too simplistic to state that pregant women should be punished for doing drugs.  Some could argue that they are already being punished, and that the child is simply an unfortunate and innocent bystander.  It is a sad fact that innocent people get injured or killed every day, but such is life.

The fact is that our society has let these people down well before they ever ended up in this predicament.  While individuals need to show some responsibility for their personal choices, we have to make sure that it was actually their choice that lead them to such an unfortunate circumstance, before we start sentencing.

First of all, some people argue that a fetus is not a human until birth and therefore does not have the rights a human has.

I happen to agree that a fetus is a human the moment of conception, however, you must consider the woman in this situation. The woman has rights just as the fetus should. But the woman's rights are different because they are insured under the law. Therefore, the woman has the right, not the fetus, to abort, or do whatever to the baby, whether or not it is morally right.

Besides that, the woman may have been having unprotected sex, or having protected sex and just have gotten pregnant on accident (yes, folks, it does happen) . This woman would have no idea that she is pregnant at all! Is it fair to her to punish her for something that was accidental, something she was unaware of?

The point I am trying to get across is that we should offer these women help, not punishment. Pregnant women who drink need treatment, not prosecution! If the reason for this punishment is to dramatically decrease the number of birth defects caused by mothers, we should spread awareness about it and allow mothers who have done drugs or have had one two many drinks have help available to them. Think of it this way, if a mother drinks and knows it's against the law, she is most likely not going to go to get help for her baby but instead hope that she doesn't cause the baby defects.  

If your really thinking about the baby, help the mother, don't punish her.

Yes, they should be punished.   It is child abuse.  It is no different from a mother forcing her children to take drugs.
