Long story short I flipped off a cop. He threw the car in reverse jumped out and attempted to fight me, I said " I have not committed any crime and if I'm not being detained I'd like to leave" The cop said " you're spending the night in detox asshole" and cuffed and frisked me. In the proccess he applied the left handcuff so hard and tight that I screamed out in pain and told him he was hurting me and after several requests he finally loosened the cuff. I replied "I'm not intoxicated and I have not commited any crime" To wich he replies "You're drunk in public". I protested to no avail and was transported to Detox and booked in. One attendent commented on the fact that I didn't appear intoxicated. I told him and the head attendent that I was in no way intoxicated and needed to call my family to let them know where I was and would like to leave as soon as the paperwork to discharge me was filed. they said "tough shit" and I was not released until the next morning. Long story short, I was NOT drunk, did NOT commit any crime and have no feeling in my left hand from my wrist to the tip of my thumb( this is 6 days later and no feeling has returned and the bruising has gotten worse)and was forced to sit in a detox center for 6 hours.

Does anyone have any advice on filing a lawsuit for use of excessive force/unnecessary civil hold etc..? I'm pretty sure I've got a strong case and would appreciate any advice. And I don't really care if flipping a cop off is a "bad idea". I feel it is my legal right and that I should be able to do it without repercussion.


In the case of an Arizona man pulled over in 1987 for flipping off a cop, a federal court rules that "no matter how peculiar, abrasive, unruly or distasteful a person's conduct may be, it cannot justify a police stop unless it suggests that some specific crime has been, or is about to be, committed....criticism of the police is not a crime."

I'm sure it's your legal right to flip off your boss as well, but if you are looking for sympathy after doing something that poorly thought out, you're looking in the wrong place.

A cop has no legal right to tell you to empty your pockets, and I've seen people forced to do so. It's all just power-hungriness (is that a word).

watch "Cops" some time, notice how they're nice to the hot girls, but to the guys they through them to the ground, and throug them in the car.

Obviously you really were drunk. If I were the cop, I wouldn't have a doubt that you were if you were crazy enough to do that. Good thing you enjoyed the night, at least.

Don't give cops the finger lesson learned.

could be disorderly conduct, but in my opinion you got what you deserved.

I was pickednup by the cops because some one hought that my airsoft gun was real. However there ws no problem because I didn't creat problem, and did as asked.

I believe that as long as you don't do something that is disturbing the peace, ie: making noise, or are not causing damage to something than you should be allowed to move your body any way you want. me and my friend tend to flip off every cop we see and they never bother us. but that might be because we have paid more in speeding tickets in one year than you and 10 other people will pay in your life.
